We would like to remind all our Landlords of the importance of conducting regular PAT tests (Portable Appliance Testing). Many Landlord‘s who carried out PAT tests when they originally started renting their properties are neglecting to have re tests done annually and between tenancies to save costs.
All electrical appliances provided by the Landlord form part of the tenancy agreement, regardless of whether it is a large fridge/freezer or a small bedside lamp. The Landlord has a duty of care to ensure that all electrical goods supplied are maintained to a safe standard as any of these appliances could cause an electrical fire or shock, possibly causing either injury or worse still death of a Tenant. The Landlord must supply appropriate instruction manuals to ensure the appliances safe usage and any items manufactured after 1st January 1997 must be marked with the appropriate CE symbol
Legislation regarding Electrical Safety includes: The Electrical Equipment (Safety) Regulations 1994 and the The Consumer Protection Act 1987 and failure to comply is a criminal offence and may result in:
- A fine of £5,000 per item not complying
- Six month’s imprisonment
- Possible manslaughter charges in the event of deaths
- The Tenant may also sue you for civil damages
- Your property insurance may be invalidated
